What Are LUDS?

LUDs, or “Local Usage Details”, refers to local telephone records of phone calls made and received by a particular number.

In other words, when you make or receive a phone call, the details concerning the call are recorded by your telephone company and such details are considered to be your phone LUDs.

LUDs include can include information such as:

  • Incoming call information
  • Outgoing call information 
  • Local call details
  • International call details
  • Call duration 
  • Call rates
  • Fees, charges, and toll information 

Phone activity and usage can be tracked for all types of phones whether it’s a landline phone, mobile phone, or any other type of device used to make calls.

You may have heard someone on the Law & Order show mention things like “dumping phone lines”, “getting LUDS”, or “I’ll need to get LUDs”.

That’s because the show depicts the fact that in real-life law enforcement is able to legally get a person’s call logs by virtue of Title III of the 1968 Omnibus Crime Control and Safe Streets Act, the Patriot Act, or other acts when they have reasons to believe that a suspect may have used (or will be using) the phone device to commit a crime.

Phone Companies

Typically, call logs and details are recorded by phone companies in order to keep track of their client’s phone usage for billing purposes.

As such, keeping a good phone log allows your phone company to know how much income and outgoing calls were made locally, nationally, internationally so they can bill you based on the applicable rates.

LUD records are kept in accordance with the specific company’s data retention policy intended to ensure they keep the evidence in case of a dispute or lawsuit, or to comply with legal data retention law requirements.

Investigations

LUDs can be quite useful for law enforcement agencies and the police.

In fact, quite often, law enforcement and the police authorities will want to get phone LUDs from a telecommunication company in the context of an ongoing investigation or to prosecute a criminal case.

The same way that the police will need a court order to tap into someone’s phone in the context of an investigation, to receive LUDs will also require that the police obtain the court’s prior authorization.

In many cases, the legal standards for getting the court authorization to access LUDs may be less onerous than obtaining a warrant to search someone’s property to possibly seize evidence.

Data Privacy

The information a phone company records about your phone activity and the logs represent your private and personal information.

It is fair to say that your phone company has a valid reason to keep track of your calls as they need to track your phone usage for billing purposes.

However, any other use of your LUDs may be in violation of the privacy and data protection laws.

To the extent the phone company has to comply with a warrant, subpoena, or legal duty to disclose information to the law enforcement agencies, you cannot claim a violation of your privacy rights in most cases.

However, if your LUDs are used to track your whereabouts, transactions that you are completing, identifying your contacts, without justification, that may be against the law and punishable.
